If your shop has repaired, furnished supplies or materials, towed or stored a vehicle and have not been paid for the services rendered, your shop has a lien (mechanic lien) against the vehicle. The lien arises at the time the registered owner is presented with a written statement of charges for completed work or services. Now, differing states have differing time periods to allow for satisfaction of the lien. Here in Florida where The Title Lady is headquartered, that time period is 7 days "after" the repairs are completed.
Important Facts:
-The Mechanics lien must be filed within 7 days after repairs are completed to accrue "storage"
-The lienholder (i.e. bank or lender) has the right to inspect the repairs within 3 days after receiving notice.
-Car can no be sold or transferred until 60 days after work has been completed.
-When you file a lien there is 30 days until the sale and transfer of title and only 7 days of storage will be applied.
